Terms of Use
Draft - have a lawyer review before you rely on it. This is written to match what the app actually does, which is the part most templates get wrong, but it is not legal advice.
These Terms govern your use of the VetMD mobile application and this website (together, the “Service”), operated by VetMD LLC, an Illinois limited liability company (“VetMD,” “we,” “us”). By using the Service you agree to these Terms. If you do not agree, do not use the Service.
Not veterinary advice
This is the most important term here. VetMD provides general information and record-keeping tools only. It does not diagnose conditions, does not provide veterinary medical advice, and does not replace examination and treatment by a licensed veterinarian. Information generated by the symptom guidance feature is produced by an automated system and may be incomplete or wrong. Always consult a veterinarian about your pet's health, and seek emergency veterinary care immediately if your pet is in distress. You are solely responsible for decisions you make about your pet's care.
Who may use the Service
You must be at least 13 years old and able to form a binding contract. The Service is intended for use in the United States. If you create an account you are responsible for the accuracy of the information you provide and for keeping your credentials secure.
Your content
The pet records, notes, photos and receipts you enter remain yours. You grant us only the licence needed to host, process and display that content back to you, and to operate the features you use - nothing more. We do not use your pet health records to train AI models. You are responsible for having the right to upload anything you upload.
Acceptable use
- Do not use the Service for anything unlawful, or to harm an animal or a person.
- Do not attempt to access another user's records, probe or disrupt our systems, or bypass any access control.
- Do not scrape, resell or redistribute the Service or its content.
- Do not upload malware, or content you have no right to share.
- Do not present output from the symptom guidance feature as veterinary advice to others.
Subscriptions
Core features are free. VetMD Plus is a paid subscription sold through the Apple App Store. Payment is charged to your Apple ID at confirmation of purchase. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Manage or cancel in Settings → [your name] → Subscriptions on your device. Refunds are handled by Apple under its own policies; we cannot issue them directly. Prices may change, and we will give notice before a change takes effect for you.
Third-party services and information
The Service shows information from third parties, including clinic and store listings from Google Maps Platform. We do not control, verify or endorse that information, and listings can be inaccurate or out of date. Confirm hours, services and credentials directly with any provider before relying on them.
Availability
We aim to keep the Service running but do not guarantee uninterrupted availability. We may modify, suspend or discontinue features at any time. We will give reasonable notice before discontinuing the Service as a whole so you can export or record what you need.
Your account and termination
You can delete your account at any time from within the app (Settings → Delete my account), which permanently removes your data as described in the Privacy Policy. We may suspend or terminate an account that violates these Terms or that we reasonably believe poses a risk to the Service or other users.
Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free, that reminders will be delivered, or that any information provided is accurate, complete or current. Reminder notifications are a convenience, not a guarantee - do not rely on them as the only record of your pet's care schedule.
Limitation of liability
To the maximum extent permitted by law, VetMD LLC will not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill, arising out of or relating to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim, or fifty US dollars. Some jurisdictions do not allow these limitations, in which case they apply to the fullest extent permitted.
Indemnity
You agree to indemnify and hold harmless VetMD LLC from claims arising out of your misuse of the Service, your violation of these Terms, or your violation of the rights of another.
Governing law
These Terms are governed by the laws of the State of Illinois, without regard to its conflict of laws rules. The state and federal courts located in Cook County, Illinois have exclusive jurisdiction over any dispute that is not resolved informally.
Apple
Apple is not a party to these Terms and has no obligation to provide support for the app. If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
Changes
We may update these Terms. If we make material changes we will update the effective date above and, where appropriate, notify you in the app. Continued use after changes take effect means you accept the revised Terms.
